Official Sweepstakes Rules

By entering the GEICO’s Annual Gathering 2020 Sweepstakes (“Sweepstakes”), each Entrant agrees to the following:

Eligibility: The sweepstakes is limited to members of American Mensa, Ltd. who are members as of January 14, 2020, who are 18 years of age and older and are legal U.S. residents of the 50 states and the District of Columbia (“Entrants”). No purchase is necessary to enter or win. A purchase will not impact or increase your chance of winning. Paid employees of American Mensa and employees and agents of GEICO or any entity associated with the Sweepstakes, as well as members of the same household of any such employee or agent, may not participate.

Sweepstakes Period: The sweepstakes will begin on January 14, 2020, and end on April 30, 2020.

How to Enter: In order to enter, complete the online entry form at americanmensa.org no later than 11:59 p.m., Central time, on April 30, 2020. INTERNET ACCESS AND A VALID EMAIL ADDRESS ARE REQUIRED TO PARTICIPATE. Attempted entries submitted in any other manner or at any other time will be rejected without notice to the submitter. Each entry must include the entrant’s name, American Mensa ID number, address, age and a valid email address. Entries are limited to one entry per person. If an Entrant completes multiple entry forms, only the first entry will be considered. No robotic, programmed, script, macro or other automated entries will be accepted. In the event of a dispute regarding the identity of an Entrant, the “authorized account holder” is deemed as the natural person who is attached to their name by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address Internet entry must be made by the Entrant. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void that Entrant’s entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be received by the end of the Sweepstakes Period in order to participate. All entries become the property of Administrator and Sponsor. By entering in the manner described above, Entrant consents (a) to being contacted by American Mensa and Sponsor and their respective affiliates; and (b) to be bound by, and comply with, all of the terms and conditions set forth in these Official Sweepstakes Rules.

Prize: The Prize consists of two 5-day 2020 Annual Gathering registrations, hotel accommodations for two from July 1-5, 2020, and two tickets to the Gala Dinner with TBD on TBD. The total retail value of the prize is up to $1,500, taxes included.

Selection of the Winner and Notification: The winning entry (“Winner”) will be randomly drawn from all eligible entries by Administrator during the week of May 6, 2020. Administrator will post the name of the Winner at americanmensa.org by the following week (or as soon as administratively practicable). Administrator will contact the Winner and verify eligibility via the email address provided in the online entry form. Prizes are not transferable or exchangeable and may not be substituted. If a Winner: (a) is unreachable; (b) does not make direct contact with Administrator by the time specified in the notification message; or (c) fails to accept the Prize, Administrator reserves the right, in its sole and absolute discretion, to disqualify such Winner and to select a replacement Winner from the remaining qualifying Entrants. Administrator shall not be responsible for failed attempts to notify the Winners and no responsibility is assumed by Administrator for any correspondence returned as undeliverable or any other problems associated with attempt(s) to notify the Winners. Odds of winning will depend upon the number of eligible entries received.

Winner Verification: Upon the request of Administrator, each Winner must sign and return the following documents: (a) an affidavit of eligibility; (b) a liability/publicity release in form and substance satisfactory to Administrator and Sponsor; and (c) any other releases and waivers requested by Administrator and Sponsor, releasing Administrator and Sponsor from any and all liability, loss, claims, demands and causes of action for or related to personal injury, damage, theft, loss, or any other harm suffered in connection with the Sweepstakes or the Prize. If any of the foregoing documents are not completed, signed, and returned prior to deadline noted therein, or if a Winner is deemed by Administrator to be ineligible or not to have complied with these Official Sweepstakes Rules, then such Winner will be disqualified and an alternate Winner will be selected from the remaining eligible entries, time permitting.

Forfeiture of Prize: If Entrant is awarded a prize and it is later determined by Administrator that the Entrant violated these Rules or won the prize through fraudulent means, the Prize will be disqualified and the Entrant will, upon notification of such disqualification, promptly forfeit and return the prize to Administrator (and/or Administrator may cancel Entrant’s life membership dues award).

Taxes: Payment of taxes due on a prize and incidental value or income resulting from receipt of a Prize is the sole responsibility of a Winner.

Right to Publish: Except where prohibited by law, Prize acceptance constitutes a release granting Administrator and Sponsor the right to use the Winner’s name, likeness, statement (if true), biographical information, voice, and cities and states of residence for advertising, marketing and publicity purposes on a worldwide basis (without review by the Winner) and in all forms of media, without further compensation, remuneration, or other authorization. Administrator and Sponsor expressly disclaim any responsibility or liability in connection with injury or loss to any person or property relating to redemption of the Prize. Administrator and Sponsor make no representations or warranties in connection with the Prize. Restrictions, conditions and limitations apply.

Limitation of Liability: Sponsor, Administrator, their respective affiliates, subsidiaries, parent, advertising and Sweepstakes agencies, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, the “Sweepstakes Entities”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the American Mensa website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or other errors; and any entries that are late, lost, incomplete, misdirected, stolen, mutilated, or illegible, or any combination thereof. Proof of online submission is not considered proof of delivery or receipt. All entries become the property of Sponsor and will not be returned.

Release: By entering the Sweepstakes, Entrant does hereby release, discharge, indemnify and hold harmless the Sweepstakes Entities from and against all claims and damages or liability arising in connection with Entrant’s participation and/or entry in the Sweepstakes and/or receipt or acceptance of any prize awarded in this Sweepstakes or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes, including traveling related thereto. Except where prohibited by law, the Winner’s entry and acceptance of the Prize constitutes permission for the Sweepstakes Entities to use Winner’s name, photograph, likeness, statements, biographical information, voice, and city and state addresses on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. No more than the advertised number of prizes will be awarded.

General Conditions: Administrator reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes if any fraud, virus, technical failures or any other factor beyond problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Administrator in its sole discretion. In such event, Administrator reserves the right to award the Prize in a random drawing from among the eligible entries received up to the time of the impairment or take such other action deemed fair and equitable by Administrator. Administrator reserves the right to award only the number of prizes stated in these Official Rules. No more than the number of prizes stated in these Official Rules will be awarded. The Sweepstakes Entities are not responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries or email; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.

Disputes: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, American Mensa’s interpretation of these Rules, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively through arbitration in accordance with the rules of the American Arbitration Association in Arlington, Texas, at the request and expense of the party raising the dispute; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. By entering, Entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules. By entering, Entrants also consent to the jurisdiction and venue of the federal, state and local courts located in Northern District of Texas, in the event arbitration is not available.

Winner’s List: To obtain a copy of the winner’s list, send a self-addressed, stamped, #10 envelope by May 31, 2020 to American Mensa, 1200 E Copeland Rd, Ste. 550 Arlington, TX 76011. Vermont residents may omit return postage.

Changes to Rules and Dispute Resolution: Copies of these Rules are available online at Administrator’s website, americanmensa.org, in person at the National Office, 1200 E Copeland Rd. Ste. 550, Arlington, TX 76011, between the hours of 9 a.m. and 5 p.m., Monday through Friday, or by sending a request, along with a self-addressed stamped envelope, to Administrator at the above address. American Mensa may change the dates and/or terms of the Sweepstakes without prior notice and will post material changes to the online copy at its website.

Void Where Prohibited: Any and all federal, state, provincial, and local laws apply to this and all sweepstakes. This Sweepstakes is void where prohibited by law.
